What is Service by Publication?
Service by Publication is a Court authorized method of giving notice to a defendant or interested party by publishing legal notice in an approved newspaper or legal publication. It is generally used when traditional personal service cannot be completed despite proper efforts to locate and serve the party. Freestate Investigations does not decide whether publication is legally appropriate. That decision belongs to the Court. Our role begins after the Court authorizes publication or when an attorney asks us to coordinate the publication process based on a pending or granted Court Order.

We review the publication requirements specified in the Order.
We format and coordinate the notice using language contained in the Court Order or provided or approved by the attorney or client.

The notice publishes for the required period specified in the Court Order.
The publisher issues an Affidavit of Publication upon completion.

Courts may authorize Service by Publication when a defendant cannot be located, when the defendant’s whereabouts are unknown, when multiple service attempts have failed, when skip tracing has not produced a usable service address, or when due diligence has been completed and the party appears to be avoiding service.

Publication costs depend on the required newspaper or legal publication, the jurisdiction, the length of the notice, the number of required insertions, Court requirements, and whether more than one publication is required. Publication charges commonly range from several hundred dollars to more than one thousand dollars depending on the required publication and schedule. Our coordination fee is quoted separately based on the amount of administrative work involved. Every matter receives an individualized quote before work begins.

No. Freestate Investigations does not file motions asking the Court to authorize publication unless that is being done as part of a separate Court filing service specifically requested and approved. The attorney or self represented litigant is responsible for obtaining the Court’s authorization. Once the Order is issued, we can coordinate the publication process.
Freestate can format and coordinate the publication notice using language contained in the Court Order or language provided or approved by the attorney or client. We do not independently draft the legal language required by the Court or provide legal advice.

No. Publication is completed by approved newspapers, legal newspapers, or other publications designated by the Court. Freestate coordinates with those publications on the client’s behalf.
The timeline depends on the Court Order and the publication schedule. Some matters require publication once per week for a set number of weeks. The final Affidavit of Publication is usually available only after the required publication period has finished.
